Terms of Service

Agreement

By creating an account or using VistaVault, you agree to these Terms of Service. If you use VistaVault on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

The service

VistaVault provides hosted infrastructure for 3DVista virtual tours. Each subscriber receives a dedicated hosting environment, a subdomain at username.vistavault.net, and access to a dashboard for uploading, managing, and sharing tours.

VistaVault is designed specifically for 3DVista tour output. It is not intended as general-purpose file hosting or web hosting and may not be used as such.

Your account

You must provide accurate information when registering and keep it current. You are responsible for maintaining the security of your credentials. Notify us immediately if you suspect unauthorized access to your account.

You must be at least 18 years old to create an account. Accounts are non-transferable.

Plans and billing

VistaVault subscriptions are billed monthly in advance. Plans renew automatically at the end of each billing period unless cancelled before renewal.

  • You may cancel at any time. Access continues until the end of your current billing period. No partial-month refunds are issued.
  • We reserve the right to change pricing with at least 30 days advance notice. Continued use after a price change takes effect constitutes acceptance.
  • Accounts with failed or overdue payments may be suspended until payment is resolved. Sustained non-payment may result in account termination and content deletion.

Acceptable use

You may use VistaVault only to host 3DVista virtual tour content that you have the right to distribute. You may not:

  • Host content that infringes any copyright, trademark, or other intellectual property right.
  • Upload or distribute malware, viruses, or any malicious code.
  • Host illegal content of any kind, including content that sexually exploits minors.
  • Attempt to access, alter, or interfere with another subscriber's content or account.
  • Use VistaVault for general-purpose file storage, software distribution, or any hosting purpose unrelated to 3DVista tours.
  • Resell or sublicense access to VistaVault without a separate written agreement with us.
  • Use automated tools to artificially inflate bandwidth or storage metrics.

We may remove content or suspend accounts that violate these rules, with or without prior notice depending on severity.

Content ownership

You retain full ownership of the tour content you upload. By uploading content, you grant VistaVault a limited, non-exclusive license to store, serve, and deliver that content to your visitors as directed by you. We do not claim ownership of your content and do not use it for any purpose beyond operating the service.

You are solely responsible for ensuring you hold the necessary rights to all content you upload, including photography, 3D models, and any embedded assets.

Storage and bandwidth

Each plan includes defined storage and bandwidth allocations, displayed in your dashboard. If usage consistently exceeds your plan limits, we will contact you to discuss an upgrade. We reserve the right to throttle or suspend service for accounts that significantly and persistently exceed their allocation.

Your subdomain

Your subdomain (username.vistavault.net) is provided for use during your active subscription. Subdomains are not owned by subscribers, are not transferable, and revert to VistaVault upon account closure. We reserve the right to reclaim subdomains associated with inactive or terminated accounts.

Service availability

We target 99% uptime and maintain infrastructure accordingly. However, we do not guarantee uninterrupted or error-free service. Scheduled maintenance will be announced in advance where practical. We are not liable for downtime caused by factors outside our reasonable control, including infrastructure provider outages, network issues, or force majeure events.

Termination

You may close your account at any time from your account settings or by contacting us. We may suspend or terminate accounts that violate these Terms. Upon termination for any reason, your hosted content will be deleted within 30 days.

Sections of these Terms that by their nature should survive termination — including content ownership, limitation of liability, and disclaimers — will do so.

Privacy

Our Privacy Policy describes how we collect and handle data. It is incorporated into these Terms by reference.

Disclaimer of warranties

VistaVault is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by applicable law, VistaVault's total liability for any claim arising out of or relating to these Terms or the service is limited to the fees you paid us in the three months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
